



NO WIN NO FEE
Most people see pursuing a claim for personal injury as expensive but this doesn't have to be the case.
Conditional Fee Arrangements (CFA) – "No Win No Fee" mean that you can pursue your claim with the costs claimed back from the Third party. CFA's often incorporate a policy of insurance which protects you from your liability to pay your opponent's costs should you lose your claim or lose a particular issue in dispute within your claim.
CFA's give people without access to legal expense insurance or who cannot afford to personally fund their claim wider access to justice. Under our CFA Adam Solicitors will not charge you anything for our professional services should you lose your case.
We may insist on you taking out an After the Event Insurance Policy with your CFA to to protect you against the risk of paying your opponent's legal costs in the event of your claim being unsuccessful. The cost of a legal insurance premium varies depending upon the type of claim and the prospects of success. If we do insist on "After the Event Insurance" we may agree to pay the premium if you lose and your opponent will pay if you win. Win or lose, you will have peace of mind that your claim will not cost you anything. If you instruct us to pursue your claim against our advice we will not be able to continue your matter on a no win no fee basis. We will resort to our usual costs basis which will be agreed with you prior to us continuing your claim. You will be responsible for our costs, disbursements and any premiums to the same extent that the Third Party would pay if your claim were successful.
If you win your case Adam Solicitors charge a supplementary fee called a "success fee" which usually, and unless expressly stated in our agreement with you, is paid only by your opponent. The success fee is a percentage of the cost of our legal fees charged in addition to our legal costs and is almost always paid by the other side. The success fee is always a percentage rate of up to 100%. The percentage charged will be based on the risks involved in pursuing your claim.
In some cases it may not be possible to pursue your claim on a No Win No Fee basis. If this is the case we will let you know and discuss the best possible way to continue your claim. |
